Mr. Mohamed Kamboua, individual entrepreneur, registered in the SIRENE Directory, under the number 489 352 708, in his capacity as data controller, undertakes that the collection and processing of personal data of individuals, via the mobile application T-Lix (hereinafter the Application) are in accordance with the Data Protection Act of 6 January 1978, as amended by Law No. 2004-801 of 6 August 2004 on the protection of individuals with regard to the processing of personal data and the European Regulation 2016/679 of 27/04/2016 on the protection of personal data (hereinafter the Personal Data Protection Regulation).
As part of this commitment, Mr. Mohamed Kamboua has established a Personal Data Protection Policy to provide users of the Application with all the information relating to its practices regarding the collection, use and disclosure of information about them, which will have been obtained via the Application.
Only data relating to natural persons are concerned by this policy.
Mr. Mohamed Kamboua, as data controller within the meaning of the RGPD, limits the collection of personal data to data that is adequate, relevant and strictly necessary for the intermediation service (hereinafter referred to as the Service) that he offers to cab drivers (hereinafter referred to together as Drivers) and potential passengers (hereinafter referred to as Passengers).
Drivers and Passengers are together referred to as Users of the Application.
By using the Application, Users agree to the collection, use and disclosure of their personal data in the manner described in this Privacy Policy.
In the event of a change or update, the revised Privacy Policy will be posted on our Site, along with the date it was updated.
Users are encouraged to review this Privacy Policy regularly to stay informed of any changes or updates that may occur.
What personal data is collected through the Application?
The personal data concerning the Users that may be collected and processed are the following :
Personal data relating to :
the identity of Passengers when they create their customer account on the Application: their title, surname, first names, telephone number, e-mail address and postal address;
the identity of Drivers when they create their Driver account on the Application: their title, surname, first names, telephone number, e-mail address
They are mandatory for the connection between Drivers and Passengers; failure to provide this data may result in the impossibility to access the Service.
Personal data relating to the professional life of the Drivers:
photographs of the front and back of the cab driver's business card;
photographs of the front and back of the parking card;
the type, make, model, plate, engine, color and number of seats excluding the driver of the Driver's transport vehicle;
photographs of the front and back of the Driver's vehicle registration document;
the options of the transport vehicle (PMR accessibility, CPAM approved cab, provision of a baby seat, booster seat).
This information is mandatory for the connection between Drivers and Passengers: failure to provide this data may result in Drivers being unable to access the Service.
The financial data of the Drivers: the bank details of the Drivers
This information is mandatory for the connection between Drivers and Passengers: failure to provide this data may result in Drivers being unable to access the Service.
Personal data related to the requested or completed trips (date, departure address, arrival area, flight or train number in case of reservation, rating and comments given to the trip).
They consist of connection data within the framework of access to the Service as well as geolocation data.
With the exception of geolocation data, which is mandatory to access the Service, other personal data is optional, its collection allowing users to access their shopping history. Location data :
geolocation data of Passengers and Drivers when using the Application
data relating to the follow-up of the commercial relationship consisting of correspondence exchanged with Mr. Mohamed Kamboua, the management of notes and opinions on the Users of the Application;
The technical data of the Users, in particular their IP address or navigation information relating to their terminal.
When is your personal data collected?
The collection of Users' personal data takes place when : they create a customer account;
the Passengers make a request for rides via the Application ;
the Drivers accept to honor a request for a ride via the Application ;
the Users contact Mr. Mohamed Kamboua by any means of communication ;
Is data collected on minors under the age of 18?
It is necessary to be 18 years old to create an account via the Application and access the Service.
Mr. Mohamed Kamboua does not collect data from minors under the age of 18, so any User under the age of 18 must waive the creation of an account.
What are the purposes of collecting personal data from Users via the Application?
The purpose of the processing of these data is :
The execution of the Service by allowing the execution of the booking/management of the requests for rides and the realization of the transport service by the Drivers previously registered on the Application ;
The management and the commercial promotion by communication campaigns addressed by sms or emailings, to inform the Users in particular of the evolution of the Service.
Improvement of the quality of service (personalization of the offer, improvement of the knowledge of the customer by means of possibly anonymized statistic analyses)
The legal basis for these treatments is :
the contractual relationship with Mr. Mohamed Kamboua, publisher of the Application and/or ;
the legal or regulatory obligations of Mr. Mohamed Kamboua or ;
the consent, with regard to the processing of commercial prospecting, that Users may withdraw at any time by sending an email via the unsubscribe link listed in the footer of the communications ;
Personal Data required to fulfill the purposes described above are marked with an asterisk in the various pages of our Site.
Failure to fill in these mandatory fields, Mr. Kamboua will not be able to perform the Service. The other information is optional and allows the Data Controller to better know its Users and to improve its communications and its Service.
In particular, with regard to commercial prospecting, in application of the ePrivacy Directive n°2002/58/CE of July 12, 2002, Mr. Kamboua is likely to send targeted advertisements to the Users, in particular by email, postal mail, sms, on social networks or third-party websites.
Thus, when creating an account via the Application, your consent to receive such commercial communications is expressly collected.
Users always have the possibility to oppose the receipt of such solicitations by performing the following actions :
For email, by clicking on the unsubscribe link provided in each email ;
For sms, by sending a stop SMS to the number indicated in it ;
By contacting us by email or by mail according to the modalities provided for in article 9.
Who will receive your personal data?
The personal data collected through the Application are hosted and processed in the United States by Bubble Group using secure protocols. Special care has been taken to ensure that this transfer complies with applicable regulations and we have put in place safeguards to ensure a level of protection for your privacy and fundamental rights equivalent to that offered in the European Union.
Personal data is only transmitted to the service providers and partners of Mr. Mohamed Kamboua in order to ensure the proper execution of the Service and the follow-up of the commercial relationship that results from it, in particular :
Drivers registered on the Application, to access pick-up information as part of a trip request (name, address of Passengers) ;
Passengers registered on the Application to access the Driver's information when requesting a ride (Driver's name, registration of the transport vehicle, rating assigned to the Driver) ;
And, subject to the consent of the Users, to service providers involved in the commercial promotion of the Service.
Personal data will not be transferred or made accessible to any third party, except for any subcontractors of Mr. Kamboua for exclusively technical and logistical reasons (in particular, providers of hosting and maintenance of the Application, providers of mailings).
In the event that Mr. Kamboua wishes to disclose Users' personal data to partners in a manner not covered by this Privacy Policy, Mr. Kamboua will notify them in writing in advance and provide them with the opportunity to opt out of such new use or disclosure of personal data.
In addition, Mr. Kamboua may use connectors developed by third parties, which may be recipients of personal data when you use them.
Finally, Mr. Kamboua is likely to communicate to third parties the personal data of its users when such communication is required by law, a regulatory provision or a judicial decision, or if this communication is necessary to ensure the protection and defense of its rights.
How long do you keep your personal data?
Users' personal data will be kept for a period of time appropriate to the purpose of each of the processing operations listed exhaustively in Article 4.
As an exception, this data may be kept for longer periods in order to manage claims and disputes, if any, and to meet legal and/or regulatory obligations.
Thus, Mr. Kamboua undertakes to use the personal data of its Users only for the time necessary to achieve the purposes of collection:
the data relating to the history of the races, to the identity of the User registered on the Application will be consultable on the customer account as long as it remains active;
In case of prolonged inactivity on the part of the User, for a period of 3 years, the account will be deactivated.
At the end of this three-year period, Mohamed Kamboua will contact the inactive User to find out whether or not he or she wishes to: continue receiving T-Lix communications;
keep its customer account on the Application. Once the customer account is closed, personal data will be archived for evidentiary purposes for three years from the end of the commercial relationship;
identification data for the purpose of sending commercial communications will be kept for a period of three years from their collection or last contact with the Application;
The data will be destroyed within a maximum of 2 working days from the unsubscription request.
In all cases, Users have the option at any time to close their account and/or unsubscribe to T-Lix communications by sending an email to contact@tlix.app or by clicking on the unsubscribe link attached to each communication;
the connection logs collected, subject to your agreement, within the framework of the cookies and other tracers set up via the Application, will be kept for a period not exceeding six months.
What are the security measures taken by Mr. Mohamed Kamboua?
Mr. Mohamed Kamboua makes a commitment to the Users of the Application to put in place appropriate technical and organizational measures to ensure the confidentiality and security of their personal data in particular by :
implementing physical and electronic backup procedures for data collected on our Site;
Implementing a secure consultation of personal data through the implementation of a complex password policy;
ensuring that its service providers present sufficient guarantees as to the implementation of appropriate technical and organizational measures so that any processing of personal data preserves the protection of the rights of the persons concerned.
Despite the measures taken by Mr. Mohamed Kamboua, Users are informed that all information collected via the Application can potentially be intercepted and used by persons other than the intended recipient.
What are your rights regarding personal data?
In accordance with current legislation on personal data, any individual who submits personal data via the Application has the right to access and rectify the personal data, as well as to request its deletion, to object to its processing and to obtain its limitation or portability insofar as applicable.
They also have the right to define directives concerning the conservation, deletion and communication of their data after their death processed by Mr. Mohamed Kamboua, in accordance with the applicable legislative and regulatory provisions.
What are the possible claim s?
This Privacy Policy shall be governed by and construed in accordance with French law.
The French courts are territorially competent to hear any dispute relating to our Site with the exception of the application of the rules of special jurisdiction, particularly in the event of a dispute with a consumer.
